Lil Durk Judge Grants Rapper’s Motion to Sever New Charges From Murder-For-Hire Case

A federal judge has ruled in favor of Lil Durk, severing new racketeering charges from his upcoming murder-for-hire trial.

In a significant pre-trial development, Lil Durk has secured a legal victory as a judge granted his motion to sever new gang-related charges from his ongoing murder-for-hire case. The decision, handed down by Judge Michael W. Fitzgerald on Tuesday, July 14, 2026, ensures that the rapper’s trial remains on schedule for its previously set start date of August 20.

The court’s ruling specifically addresses the prosecution’s attempt to introduce newly added racketeering charges linked to alleged Only The Family (OTF) gang violence in Chicago. By severing these counts, the court has opted to maintain a singular focus on the Los Angeles murder-for-hire allegations, potentially deferring the racketeering charges to a separate future proceeding.

We are very happy with the court’s order. For 21 months, we have been unwavering in our commitment to Mr. Banks and his innocence and look forward to an Aug. 20, 2026, trial.

During the pre-trial hearing in Los Angeles, Judge Fitzgerald expressed skepticism regarding the prosecution’s strategy. According to reports, the judge admonished lead prosecutor Ian Yanniello for attempting to consolidate the Chicago-based racketeering counts with the Los Angeles murder case, noting that the prosecution appeared to be seeking a tactical advantage. The judge famously remarked, “You think you will have a better chance to win if the Chicago count is tried with the Los Angeles murder. That’s obvious. You treat that as a feature. I treat that as a bug.”

Lil Durk, born Durk Devontay Banks, has remained in custody since October 2024. He faces serious charges in connection with the 2022 killing of Saviay’a “Lul Pab” Robinson, a cousin of rapper Quando Rondo. As the legal team prepares for the August trial, the defense remains steadfast in their assertion of the rapper’s innocence.
